Data Processing Agreement (DPA)

This Data Processing Agreement (“Agreement”) forms part of the Terms and Conditions between INSART Inc. (“Processor”) and the customer (“Controller”) who uses our services via https://insart.com.

1. Subject Matter

This Agreement sets out the terms and conditions under which Processor will process personal data on behalf of Controller in the context of providing software development, fintech solutions, and related services.

2. Roles and Responsibilities

• Controller: Determines the purposes and means of the processing of personal data.
• Processor: Processes personal data on behalf of the Controller only in accordance with this Agreement or written instructions.

3. Data Processing Details

• Nature and Purpose: To deliver agreed-upon services and support to Controller.
• Types of Personal Data: Names, contact information, job titles, IP addresses, and other data necessary for business services.
• Categories of Data Subjects: Employees, customers, and users of the Controller.

4. Processor Obligations

• Process data only as instructed by Controller
• Ensure confidentiality and security of data
• Assist Controller in responding to data subject rights requests
• Notify Controller without undue delay in case of a data breach
• Delete or return personal data upon termination of services

5. Sub-processors

The Controller authorizes the use of sub-processors. The Processor shall ensure that any sub-processor is bound by similar obligations regarding data protection. A list of sub-processors is available upon request.

6. International Transfers

If data is transferred outside the U.S. or the European Economic Area (EEA), the Processor shall ensure appropriate safeguards such as Standard Contractual Clauses (SCCs) or other legal mechanisms.

7. Audit and Compliance

Upon request, Processor will provide documentation necessary to demonstrate compliance with this Agreement and allow for audits under strict confidentiality requirements.

8. Duration

This Agreement remains in effect for as long as Processor processes personal data on behalf of Controller, unless otherwise terminated in writing.
